A user is understood to customers, potential customers, guests, potential guests, assistants, candidates, workers, suppliers, collaborators, contacts as well as any user (hereinafter USER), either through the corresponding form on our website, platform and/or the Application (hereinafter Website), or through the registration form as a registered USER or in the contact section (theSite“), or by sending an e-mail to the address provided for this purpose, through e-mails addressed to our professionals and/or by any other means of communication.

The General Terms and Conditions of Use (hereinafter GENERAL CONDITIONS) are set out below, which will govern the relationship between the user who contracts and uses the technological platform accessible through its mobile application or through their PC on the website www.lapetyhotel.com , whose property is owned by the HOTEL LÀPETY and/or uses any of the services and/or registers for it.

For the purposes of these GENERAL CONDITIONS, the user, client, potential client, assistant, guest, potential guest, assistant and/or any person who contracts the services of HOTEL LÀPETY and/or uses the SERVICES offered on the platform or portal (hereinafter the USER).

3. ACCEPTANCE OF TERMS AND USE OF THE SITE

6. CONTRACTING THE SERVICES OF THE HOTEL LÀPETY AND REGISTERING AS A REGISTERED USER

The initial use or browsing of the Website does not require prior subscription or registration. However, the user who wishes to contract the services of HOTEL LÀPETY must request it from HOTEL LÀPETY, register on the portal and will be informed of the steps to follow.

Initially, the use and viewing of the website is free of charge. However, the contracting of any of the services offered by HOTEL LÀPETY, as well as the reservations, entails the acceptance of the economic conditions, prices, rates and payment conditions agreed according to the contracted services. These economic conditions will be duly informed to the user, client, potential client, guest, potential guest and/or attendee at the time of contracting the service with HOTEL LÀPETY.

7. HOTEL RESPONSABILITY

Access to the website does not imply in any case the existence of a commercial relationship between the user and HOTEL LÀPETY.

The portal only provides information about vacant hotel beds at the time of requesting the aforementioned information, so if you make the reservation online, you are contracting directly with the hotel.

The printed version of the reservation made serves as a locator when you arrive at the hotel. The reservation of hotel nights on this website implies the adherence and acceptance by the client of each and every one of the general conditions set forth herein.

By accepting the following clauses, you declare and agree:

1. Be of legal age and have full capacity to make the reservation, stating that they understand all the conditions found on the website.
2. That the data provided when making the online booking is true, complete and concise.
3. That access to this website is responsibility of the user.
4. That once the reservation has been made, the electronic document in which it has been formalized will be filed, you will be able to access it at any time.
5. That once the reservation is confirmed, a place will be reserved for you at the hotel on the dates indicated, the number of rooms and the number of people.
6. The conditions and price of the reservation made are those expressly determined in the conditions of the rate expressly included on the page where you make the reservation.
7. That your card details are collected for the purpose of guaranteeing the reservation. Payment will be made at the Hotel and when you spend the night there. In the event of cancellations or no- without prior notice or when the free booking period has expired, the booking will be cancelled and the charge set out in the tariff conditions will be charged.

8. PRICES

• The prices indicated are Retail Prices including VAT.
• The price includes: Price per night depending on the type of room and board selected.
• The price does not include: Any service not specified plus extras such as transfers, tips, phone calls, laundry services, minibar, parking, etc…
• Check-in and check-out times As a general rule and unless expressly agreed otherwise with the establishment, the rooms may be used from 2 p.m. on the day of arrival and must be vacated at 12 p.m. on the day of departure.

9. PASSPORTS AND VISAS

All travellers, without exception (including children), must carry their corresponding personal and family documentation in order, be it passport or ID card, according to current legislation.

It will be at their expense when the trips require obtaining visas, passports, vaccination certificates, etc.

Minors under 18 years of age who come alone without the accompaniment of an adult must carry a written permission signed by their parents or guardians, in anticipation that it may be requested by any authority.

In the event that entry into the country is denied due to lack of the requirements, or due to a defect in the documentation required, the hotel declines all responsibility for events of this nature, being at the expense of the consumer any expenses that may arise, as well as the costs of the loss of their reservation.

10. TERM AND VALIDITY OF THE TERMS OF USE

These GENERAL CONDITIONS and, where applicable, the SPECIFIC CONDITIONS will enter into force from the date on which this agreement between the USER and the RESPONSIBLE party is perfected and will end on the day that the user ceases to contract website services for a period of time or cancels as a registered user.

11. PLATFORMS AND SOCIAL NETWORKS

In the event that the USER contacts and/or registers with HOTEL LÀPETY through another social media account and/or third-party platforms such as, for example, but not limited to, Facebook, Twitter, LinkedIn, Instagram, and/or YouTube, among others, the USER knows and expressly consents to HOTEL LÀPETY access and use the information contained in this last profile, assuming in this case, not only the conditions and privacy policies of the third party, but also those of HOTEL LÀPETY.

In the event that the user shares or publishes and/or promotes the HOTEL LÀPETY website with another Social Media platform, social networks and/or third parties, the user agrees to comply with all the terms of use, policies and guidelines established by the corresponding Social Media platform or third parties in relation to such content. The User also agrees to be solely responsible for any claim that may arise from sharing or publishing any content, on any Social Media platform, Social Media and/or with third parties.

Social Media or third-party platforms are not partners or representatives of HOTEL LÀPETY and HOTEL LÀPETY will not be responsible for the this acts.

12. HIPERLINKS

In the event that the user places links to HOTEL LÀPETY, advertising and/or third-party websites and/or portals on the website or on any of its own platforms or social networks, HOTEL LÀPETY informs them that it is not obliged to control the services, contents, data, files, products and any kind of material or information existing on the third-party portals.

In these cases, HOTEL LÀPETY will not be liable, under any circumstances, for the legality of the contents of said page(s), being the sole responsibility of the third party, including but not limited to, respect for legality, good customs, public order, as well as those acts that infringe the rights of third parties. The existence of a hyperlink does not presuppose a professional, personal and/or any other relationship between HOTEL LÀPETY and the owner of the portal on which it is established.

The user agrees to:

Not to use or disseminate the images in photographs, magazines or films that are pornographic and/or erotic in content or whose purpose may violate the dignity, image, privacy and honour of the people who appear in them. It is understood, therefore, that the user will not exploit the photographs that may affect the private lives of the people who appear, and that the use will not be used under any circumstances for dissemination in pornographic, xenophobic, violent or illicit media.
2. The USER will use appropriate language and respectful conduct with the website,. It is forbidden to introduce obscene, pornographic, videos or photographs of minors, xenophobic, hurtful, intimidating, violent, immoral or offensive content, comments and opinions and, in general, useless for the purposes for which the website was created, as well as it will not threaten the commercial image and good name of HOTEL LAPETYand/or third parties.
3. The user will not send or publish images of minors without the proper consent of their parent/guardian and/or legal representative.

In the event that the USER places links to other sites that are not considered social networks, the USER will need the express written authorization of HOTEL LAPETY and will be responsible for complying with the rules established both with the other sites from which it comes, and with the HOTEL LAPETY website.

In all these cases, HOTEL LAPETY may cancel, cancel, restrict and/or block the account of the USER who has carried out the action contrary to these conditions and/or the regulations

14. INTELLECTUAL PROPERTY, IMAGE RIGHTS AND INTELLECTUAL PROPERTY RIGHTS OF THE COMPANY

The USER also undertakes not to suggest or incite third parties or third parties competing with HOTEL LÀPETY to carry out actions prohibited by law or acts of unfair competition that impede the positioning of the company, that generate confusion, association, that produce a discredit in the image, trademark or trade name, that generate contempt or that are comparative acts in order to hinder the implementation, development and correct evolution of HOTEL LÀPETY in commerce.

• The user authorises that the photographs, images and recordings in which the user appears may be used by HOTEL LÀPETY, as promotional material, advertising and corporate dissemination in all its aspects, such as, for example, but not limited to, social networks, advertising campaigns in the press, radio and television, brochures, catalogues, promotional material and/or merchandising. promotional videos and/or events, websites, advertising material at points of sale, advertising emails and/or corporate mailings, among others.
• The user consents that HOTEL LÀPETY may have full access to the use of the material, without restrictions, for any purpose, and may make any modifications thereto that they deem appropriate, including but not limited to, modification of images, videos and recordings, alteration of photographs, combination of images, incorporation into other texts and/or graphics.
• The user consents that the images and videos in which they appear may appear on the Social Networks of events, services and/or activities that have been carried out by HOTEL LÀPETY.

From HOTEL LÀPETY, we inform you that all images will be treated with the utmost confidentiality and all the necessary security measures are being applied for their treatment.

Likewise, we inform you that HOTEL LÀPETY will at no time use the images for any purpose other than that set out herein. In addition, HOTEL LÀPETY undertakes not to carry out an exploitation of the images susceptible to the one set out herein, and that use WILL NOT SERVE for the dissemination in media of a pornographic, xenophobic, violent or illicit nature and/or that may violate dignity and honour, in which case the authorisation will be invalid and may be revoked.

HOTEL LÀPETY undertakes to observe at all times the regulations relating to Civil Protection, Honour, Personal and Family Privacy and Self-Image.

Consequently, the user gives their consent to HOTEL LÀPETY to use, reproduce, communicate, display and publicly present on paper and/or digital and in any other medium, the photographs, images, drawings, films, recordings, opinions, comments and/or presentations, among others, that contain the user’s image.

The user, client or guest confirms that whatever the use, type or importance of the dissemination, that they will not receive remuneration or compensatory benefits of any kind, including compensation, for the use of the videos, images, photographs, comments, opinions and/or presentations, among others, that are made on the user’s images, Client or guest.

The user, client or guest hereby unconditionally exempts and releases HOTEL LÀPETY from all claims, liabilities, risks, demands, actions, causes of action, costs and expenses of any kind, legal or by law, known or unknown, anticipated or unanticipated, suspected or not suspected, that it has now or may have, produced by the use of videos, images, photographs, comments, opinions, recordings and/or presentations, among others, used by HOTEL LÀPETY. Consequently, the user, client or guest undertakes not to sue or initiate proceedings, claims or lawsuits against HOTEL LÀPETY in relation to the aforementioned regarding the images and their use.

16. ACTIONS OF HOTEL LÀPETY FOR THE SURVEILLANCE AND PROPER FUNCTIONING OF THE PORTAL

Each of the provisions of these clauses must be interpreted separately and independently of the others

If any clause included in these GENERAL CONDITIONS and/or the PARTICULAR CONDITIONS is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect said provision that is null or ineffective, the GENERAL CONDITIONS and the PARTICULAR CONDITIONS subsisting in all other matters.

23. DISPUTE RESOLUTION, APPLICABLE LAW AND JURISDICTION

For any dispute, the USER must contact the Customer Service Department, to try to resolve the conflict as soon as possible.

In the event that it cannot be resolved, at HOTEL LÀPETY we promote an amicable settlement through arbitration.

In the event that the matter cannot be resolved amicably, for any question or divergence that may arise regarding the website, contents and contracted services, the USER and HOTEL LÀPETY, expressly waiving any other jurisdiction that may correspond to them, are expressly subject to the application of Spanish Legislation, the Spanish Courts being equally competent, with express submission to the jurisdiction of the Courts of Tarragona, unless the applicable legislation imperatively determines another jurisdiction or different legislation.
